Regulatory Provisions to Promote Program Efficiency, Transparency, and Burden Reduction

The Centers for Medicare & Medicaid Services (CMS) has issued a proposed rule to revise the applicable conditions of participation (CoPs) for providers and conditions for coverage (CfCs) as a continuation of efforts to reduce regulatory burden in accordance with the January 30, 2017, Executive Order “Reducing Regulation and Controlling Regulatory Costs” (Executive Order 13771).


Of note, CMS proposes to remove the requirement for ASCs to have a transfer agreement or that all ASC physicians have admitting privileges with a local hospital. CMS is also proposing significant changes to medical history and physical assessment (H&P) requirements and a reduction in many of the new emergency preparedness requirements.
